Assessment Collection for Condo and HOA

Every owner in a community association is required to pay assessments which are used to maintain and repair the common property and facilities.  Where owners do not pay their assessments promptly when due,  the association must act to collect assessments in compliance with the association's governing documents and applicable law.

Collection Procedures

We advise boards of directors how to establish clear and enforceable collection procedures.  And, our attorneys explain the collection options such as filing  a lien against an owner's property and filing a court suit against the owner.  We also help boards understand lender foreclosure, owner bankruptcy and  other obstacles to collecting assessments.

Liens, Suits and Garnishment

Our attorneys and staff work closely with association boards and management in collecting delinquent assessments by demand letters to owners, filing liens and law suits, garnishing wages and bank accounts and, where necessary, selling an owner's property.  As advocates for the association, our goal is to collect as much money at the least cost to the association.
